These Terms of Use and End User License Agreement (“Terms”)govern your access to and use of The Hunt mobile application, website, creatortools, location-based experiences, QR-code features, augmented-realityfeatures, subscriptions, premium features, player packs, hunt-creation tools,user-generated content features, sponsor features, discovery pages, offers, andrelated services (collectively, the “Services”).

Throughout these Terms, “The Hunt,” “we,” “us,” and “our”refer to The Hunt LLC. “You” and “your” refer to any person who accesses oruses the Services, including players, creators, subscribers, team members,sponsors, retailers, venues, territory managers, parents or guardians, and anyperson who submits, publishes, shares, sponsors, customizes, or participates ina Hunt.
By downloading, accessing, creating an account, subscribingto, purchasing, creating, publishing, sharing, joining, sponsoring,customizing, submitting content to, or using any part of the Services, youagree to be bound by these Terms. If you do not agree to these Terms, do notuse the Services.
1. Important Notice
The Hunt is a real-world, location-based entertainmentplatform. Using the Services may involve visiting physical locations, walkingor traveling in public areas, entering third-party businesses, scanning QRcodes, interacting with other users, participating in creator-generatedexperiences, viewing sponsor offers, and using augmented-reality orlocation-verification features.
You are responsible for your own safety, conduct, legalcompliance, and judgment while using the Services.
The Hunt does not supervise your real-world activity,guarantee the safety or suitability of any location, guarantee that anybusiness or venue will be open or available, or provide emergency, navigation,security, transportation, legal, medical, or law-enforcement services.
2. Eligibility
2.1 Minimum Age
You must be at least 13 years old to use the Services. Usersunder 13 are not permitted to create an account, participate in Hunts, usecreator tools, use sponsor tools, submit content, or otherwise access theServices.
2.2 Users Under 18
If you are at least 13 but under the age of majority in yourjurisdiction, you may use the Services only with the consent and supervision ofa parent or legal guardian. By allowing a minor to use the Services, the parentor guardian agrees to these Terms on the minor’s behalf and is responsible forthe minor’s use of the Services.
2.3 Parent and Guardian Responsibility
Parents and guardians are responsible for:
Supervising minors’ use of the Services;
Determining whether a Hunt, route, location, venue, offer,theme, clue, puzzle, image, audio, story, mature label, sponsor content, oractivity is appropriate for the minor;
Ensuring the minor complies with these Terms and applicablelaw;
Preventing minors from entering age-restricted venues orparticipating in inappropriate activities;
Monitoring any paid purchases, subscriptions, player packs,premium features, creator tools, or sponsored experiences used by the minor.
2.4 Age-Restricted Features and Locations
Some Hunts, offers, venues, or experiences may involve orroute users near or into age-restricted establishments, including bars,breweries, wineries, distilleries, restaurants serving alcohol,cannabis-related businesses, 18+ or 21+ venues, or events that may not beappropriate for minors.
You are solely responsible for confirming that you arelegally permitted to enter any location, consume any product, participate inany activity, or redeem any offer.
The Hunt does not control any third-party business’sage-verification, identification, admission, service, product, cannabis,alcohol, tobacco, gambling, adult-entertainment, or other regulated-productpolicies.
2.5 Declared Age, Age Categories, and Mature Content
The Services may use declared age, verified age, accountinformation, device-level information, app-store information, or otheravailable information to determine whether a user may access certain Hunts,features, locations, offers, creator content, sponsor content, QR-code content,augmented-reality content, or age-restricted experiences.
The Hunt currently uses age categories that may include 13+,18+, and 21+. The Hunt may add, remove, modify, or enforce age categories atany time.
Certain Hunts or content may be labeled General or Mature.Mature content may include stronger language, darker themes, horror, fictionalviolence, adult humor, controversial subject matter, age-restricted locations,or other material that may not be appropriate for all users. Mature contentdoes not permit illegal content, pornography, explicit sexual content,child-safety violations, hate, harassment, infringement, unsafe activity, orany other prohibited content.
Creators, sponsors, customizers, and users are responsiblefor accurately identifying and labeling content, locations, and offers that maybe mature, age-restricted, or inappropriate for certain users. The Hunt maychange, override, add, remove, or enforce any age rating, age category, contentlabel, or access restriction at any time.
Users who do not meet the applicable age category may beblocked from accessing certain Hunts, locations, offers, creator content,sponsor content, QR-code content, or features.
3. Description of the Services
The Hunt provides real-world, location-based entertainmentexperiences, including official Hunts created or approved by The Hunt anduser-created Hunts created through our creator tools.
The Services may include:
Story-driven Hunts;
Clues, riddles, puzzles, and challenges;
QR-code scanning;
Location verification;
Augmented-reality features;
Team play;
Scores, achievements, badges, and leaderboards;
Retailer, sponsor, or venue offers;
Sponsor discovery pages and QR-code records;
Creator tools that allow users to create, edit, inviteothers to, share, and submit Hunts;
Customizer tools that allow users to create or modifylocations, clues, hints, discovery points, checkpoints, QR content, or relatedHunt elements;
Premium subscriptions or paid creator access;
Player packs or other one-time digital purchases;
AI-assisted content generation, editing, or narrationfeatures;
Website and account-management features;
Reporting, blocking, moderation, review, and safety tools.
The Services are offered for entertainment, communityengagement, training, education, team-building, and similar lawful purposes.They are not emergency tools, navigation tools, safety-monitoring tools,transportation services, legal advice services, medical advice services, orprofessional advice services.
4. Account Registration and Security
4.1 Account Creation
You may be required to create an account to access certainfeatures, including joining Hunts, saving progress, using creator tools,purchasing premium access, creating teams, creating or managing sponsorrecords, submitting content, accessing age-restricted content, or reportingcontent.
You agree that all information you provide is accurate,current, and complete. You must keep your account information up to date.
4.2 Account Credentials
You are responsible for maintaining the confidentiality ofyour login credentials and for all activity under your account.
You must promptly notify us at hq@jointhehunt.io if youbelieve your account has been compromised or used without authorization.
4.3 No Account Sharing for Abuse
You may not sell, rent, lend, transfer, share, or provideaccess to your account in a manner that violates these Terms, bypasses paymentrequirements, evades enforcement action, enables cheating, infringes rights,facilitates misuse of the Services, bypasses age restrictions, or misrepresentsidentity, authorization, or affiliation.
5. Privacy Policy
Our Privacy Policy explains how we collect, use, disclose,store, and protect information related to the Services, including accountinformation, gameplay data, location information, creator content, sponsorcontent, purchase status, diagnostics, and support communications.
The Privacy Policy is incorporated into these Terms byreference.
By using the Services, you acknowledge that you have readand understood the Privacy Policy.
6. Location Services and Geolocation
6.1 Location-Based Functionality
Certain features require access to your device’s locationservices, including GPS, Wi-Fi, cellular, Bluetooth, or other locationtechnologies.
Location information may be used to:
Enable location-based gameplay;
Verify arrival at checkpoints;
Confirm QR-code scans;
Validate offer eligibility or redemption events;
Support fraud prevention;
Support aggregated reporting;
Improve the Services;
Support safety, moderation, app-store compliance, andtroubleshooting.
6.2 Active Use
The Hunt is designed to collect location information onlywhen reasonably needed for active app functionality, including active Hunts,check-ins, QR-code scans, arrival verification, creator tools, directions,sponsor features, or similar features.
You may disable location permissions through your devicesettings. Some features may not work if location permissions are disabled.
6.3 Accuracy Limitations
Location data may be inaccurate, delayed, incomplete,unavailable, or affected by device settings, network conditions, indoorenvironments, physical obstructions, operating system behavior, third-partymapping services, or GPS limitations.
The Hunt is not responsible for inaccurate locationinformation, failed check-ins, failed arrival verification, incorrectdirections, inability to complete a Hunt, inability to redeem an offer, or anyinjury, loss, or damage resulting from reliance on location data.
6.4 No Safety Monitoring
The Hunt does not monitor your location for safety purposes,emergency response, rescue, supervision, or law-enforcement assistance. You areresponsible for your own safety and for the safety of minors, guests, invitees,or team members participating with you.
7. Real-World Activity, Safety, and Assumption of Risk
7.1 Inherent Risks
Using the Services may involve walking, driving, biking,using public transportation, crossing streets, entering buildings, visitingunfamiliar areas, interacting with other people, participating with teams,using a mobile device in public, visiting businesses, scanning QR codes,redeeming offers, and engaging in physical activity.
These activities involve inherent risks, including:
Trips, slips, falls, and collisions;
Traffic or transportation accidents;
Weather-related risks;
Crime, harassment, or unsafe public conditions;
Food, drink, environmental, or allergy risks;
Lost, stolen, or damaged property;
Device damage;
Interactions with strangers;
Entry into areas that may be crowded, closed, unsafe,restricted, or unsuitable;
Errors or omissions in third-party maps, business hours,venue information, or location information.
7.2 Assumption of Risk
By using the Services, you voluntarily assume all risksassociated with participating in Hunts, visiting locations, following clues,traveling to checkpoints, scanning QR codes, redeeming offers, interacting withother users, using augmented-reality features, and engaging in any relatedreal-world activity.
7.3 Safety Obligations
You agree that you will:
Obey all laws, traffic rules, posted signs, and venue rules;
Not use the app while driving or operating a vehicle;
Not trespass or enter restricted, private, dangerous, orclosed areas;
Not run, rush, climb, jump, or behave recklessly to completea Hunt;
Remain aware of your surroundings;
Respect public and private property;
Respect business employees, customers, residents, andmembers of the public;
Use common sense and independent judgment at all times;
Stop participating if conditions are unsafe orinappropriate.
7.4 No Duty to Inspect
The Hunt does not guarantee that any route, venue, sidewalk,road, business, park, campus, public space, private property, sponsor location,or checkpoint has been inspected, approved, monitored, verified, or determinedto be safe.
8. Release, Waiver, and Hold Harmless for Real-WorldActivity
8.1 Definition of The Hunt Parties
For purposes of these Terms, “The Hunt Parties” means TheHunt LLC and its owners, members, managers, officers, directors, employees,contractors, representatives, affiliates, successors, assigns, serviceproviders, sponsors, retailers, participating venues, territory managers,app-store partners, payment processors, and other business partners.
8.2 Release and Waiver
To the fullest extent permitted by law, you, on behalf ofyourself and your heirs, executors, administrators, personal representatives,successors, and assigns, knowingly and voluntarily release, waive, discharge,and agree not to sue The Hunt Parties from and against any and all claims,demands, causes of action, liabilities, losses, damages, costs, and expensesarising out of or related to:
Your use of the Services;
Your participation in any Hunt;
Your travel to, from, at, near, or between any Huntlocation;
Your presence at or near any Hunt location, checkpoint,venue, retailer, sponsor location, public area, or private property;
Your interaction with any business, venue, property owner,employee, user, team member, guest, invitee, sponsor, or member of the public;
Your scanning of QR codes;
Your redemption or attempted redemption of offers;
Your use of location, map, direction, QR-code, AR, orgameplay features;
Your participation in any real-world activity connected tothe Services.
This release includes claims arising from ordinarynegligence, premises conditions, traffic, walking, driving, biking, publictransportation, weather, crowds, business operations, third-party conduct,inaccurate location information, unavailable locations, denied entry, food orbeverage issues, allergic reactions, property damage, lost or stolen property,emotional distress, personal injury, illness, or death, except to the extentsuch claims cannot be released under applicable law.
8.3 Voluntary Participation
You acknowledge that Hunts may involve inherent andunforeseeable risks, including travel through public areas, entry intothird-party locations, interaction with other people, reliance on mobiledevices, changing real-world conditions, and conditions outside The Hunt’scontrol.
You voluntarily assume all such risks.
8.4 Hold Harmless
You agree to hold harmless The Hunt Parties from and againstclaims, liabilities, damages, losses, costs, and expenses arising out of orrelated to your use of the Services, your participation in any Hunt, yourconduct, your violation of these Terms, your violation of law, your UserContent or Creator Hunt, your selection or use of any location, your placementor use of any QR code or physical material, your interaction with any thirdparty, or any claim brought by another person arising from your acts, omissions,invitations, content, or participation.
8.5 Limits Required by Law
Nothing in these Terms is intended to release liability forgross negligence, willful misconduct, intentional misconduct, or any otherliability that cannot be limited or excluded under applicable law.
9. Official Hunts, Creator Hunts, and Private Hunts
9.1 Official Hunts
Some Hunts may be created, sponsored, reviewed, approved, orpublished by The Hunt or its authorized partners. These may include officialstory Hunts, sponsored Hunts, retail Hunts, territory-manager-supported Hunts,training Hunts, or other approved experiences.
9.2 Creator Hunts
The Services may allow users to create, edit, customize,save, test, publish, share, or invite others to participate in Hunts (“CreatorHunts”). Creator Hunts may include user-generated text, clues, puzzles,answers, hints, images, audio, videos, locations, QR codes, checkpointinformation, venue names, route information, themes, stories, teaminstructions, discovery points, AR elements, or other materials.
9.3 Private by Default
Creator Hunts are private by default unless otherwise statedin the Services. Private Creator Hunts are generally accessible only to usersinvited by the creator, users who receive an authorized link or QR code, orusers otherwise granted access through the Services.
Private status does not mean that a Creator Hunt is exemptfrom these Terms. Private Creator Hunts must comply with all content, safety,intellectual-property, location, age-rating, moderation, and conduct rules inthese Terms.
Private status also does not mean that a Creator Hunt isconfidential from The Hunt. The Hunt may access, review, store, use, test,moderate, preserve, and process private Creator Hunts as described in theseTerms.
9.4 Public Submission and Review
A Creator Hunt will not become publicly discoverable,publicly promoted, or treated as an official or public Hunt unless it isformally submitted for review and approved by The Hunt.
The Hunt has sole discretion to approve, reject, edit,request changes to, unpublish, remove, or decline to feature any Creator Huntfor any reason, including quality, safety, legal, brand, content, operational,intellectual-property, partner, age-rating, app-store, user-experience, orbusiness reasons.
Submission for review does not guarantee approval,publication, promotion, monetization, sponsorship, compensation, analyticsaccess, or continued availability.
9.5 No Endorsement of Creator Hunts
The Hunt does not endorse, guarantee, or assumeresponsibility for Creator Hunts merely because they are created, hosted,shared, or accessed through the Services. Creator Hunts are the responsibilityof the creator unless expressly identified as an official Hunt approved by TheHunt.
9.6 General and Mature Creator Hunts
Private Creator Hunts may be required to be marked as eitherGeneral or Mature before they are shared, launched, or made available toinvited users.
A General Creator Hunt is intended for users age 13 andolder and should be appropriate for The Hunt’s general audience.
A Mature Creator Hunt may include stronger language, darkerthemes, adult humor, fictional violence, horror, controversial viewpoints, orother content that may not be appropriate for all teen users. Mature CreatorHunts may be subject to additional access restrictions, including 18+ or 21+restrictions where appropriate.
The creator is responsible for selecting an accurate labeland age category. Mislabeling content, failing to disclose mature content,failing to apply appropriate age restrictions, or attempting to bypass agecontrols is a violation of these Terms.
The Hunt may review, relabel, restrict, disable, remove, orrequire changes to any Creator Hunt if we determine that the selected label,age category, description, content warning, location, offer, or audience isinaccurate, incomplete, misleading, unsafe, unlawful, inconsistent withapp-store requirements, or otherwise inappropriate for the Services.
Public Hunts are expected to be appropriate for users age 13and older unless The Hunt expressly approves a different age category orrestriction.
10. Creator Responsibilities
If you create, edit, customize, submit, publish, share, orinvite others to a Creator Hunt, you are responsible for the content, legality,safety, suitability, age appropriateness, and permissions associated with thatCreator Hunt.
You represent and warrant that:
You have all rights, licenses, permissions, consents, andauthority needed to create, upload, share, publish, and authorize The Hunt touse the Creator Hunt and all related content;
Your Creator Hunt does not infringe or violate anycopyright, trademark, trade secret, patent, privacy right, publicity right,moral right, contractual right, property right, or other right of any person orentity;
Your Creator Hunt does not contain unauthorized copyrightedcharacters, fictional worlds, branded assets, logos, celebrity likenesses,music, videos, images, artwork, sports team marks, school marks, corporatemarks, product names, franchise references, or other protected material unlessyou have all required rights or written approval from The Hunt after submittingdocumentation;
Your Creator Hunt does not imply sponsorship, endorsement,approval, affiliation, partnership, or participation by any business, venue,school, property owner, municipality, organization, brand, celebrity, rightsholder, or other third party unless you have proper authorization;
Every location, checkpoint, QR placement, route, andinstruction in your Creator Hunt is lawful, reasonably safe, appropriate, andeither publicly accessible or properly authorized where authorization isrequired;
Your Creator Hunt does not instruct users to trespass, enterrestricted areas, interfere with business operations, disturb residents,disrupt schools, obstruct public spaces, violate venue rules, or engage inunsafe conduct;
You have obtained all required permissions before placing QRcodes, signs, materials, or other items on property you do not own or control;
Your Creator Hunt is appropriate for its intended audienceand any age rating, category, maturity label, description, or content warningyou assign to it;
You will promptly correct, remove, or disable any CreatorHunt or content that becomes inaccurate, unsafe, unauthorized, infringing,misleading, inappropriate, or unlawful.
10.1 Creator Acknowledgement and Certification
Before creating, uploading, saving, sharing, launching,submitting, or publishing a Creator Hunt or other User Content, you may berequired to review and accept The Hunt’s Terms, Creator Access Guidelines,Content Guidelines, Sponsor Guidelines, Customizer Guidelines, Public CreatorPublishing Guidelines, or other applicable rules.
The Hunt may record and retain your acceptance, includingyour user ID, account information, timestamp, version of the applicable termsor guidelines accepted, content record, Hunt record, QR-code record, sponsorrecord, location record, or other related information.
By creating, uploading, saving, sharing, launching,submitting, or publishing a Creator Hunt or other User Content, you certifythat:
You have the legal right to submit and use the content;
You have accurately labeled the content as General or Maturewhere applicable;
You have applied any required 13+, 18+, or 21+ restrictions;
The content does not violate these Terms;
The content does not require trespassing, unsafe activity,illegal activity, harassment, unwanted contact, or disruption of a person,business, sponsor, venue, property owner, school, public agency, or thirdparty;
The content does not falsely imply sponsorship, endorsement,approval, participation, or affiliation;
You will promptly correct or remove content if it becomesinaccurate, unsafe, unauthorized, infringing, misleading, inappropriate, orunlawful.
The Hunt may treat false, incomplete, or misleadingcertifications as a violation of these Terms.
11. Locations, Venues, Businesses, and Property Rights
11.1 Creator Use of Real-World Locations
Creators may choose to use real-world locations, includingbusinesses, schools, parks, campuses, public areas, private venues,neighborhoods, or other places as checkpoints or references.
If you use a real-world location in a Creator Hunt, you aresolely responsible for ensuring that the use is lawful, safe, appropriate, andauthorized where authorization is required.
11.2 No Misleading Sponsorship
You may not state, imply, or suggest that a business, venue,brand, school, property owner, city, municipality, nonprofit, public agency,sports team, celebrity, or other third party sponsors, endorses, approves,participates in, or is affiliated with your Creator Hunt unless you havewritten authorization.
11.3 Private Property and QR Placement
You may not place QR codes, signs, stickers, markers,objects, flyers, or other materials on private property, inside a business, ata school, on a campus, in a venue, or on public property unless you have allrequired permissions.
You may not instruct users to scan codes, retrieve objects,enter areas, or interact with property in a way that violates property rights,venue rules, public rules, or applicable law.
11.4 Sensitive Locations
You may not create Hunts that target, exploit, interferewith, or inappropriately route users to or through sensitive locations,including:
Private residences without permission;
Schools, daycares, or child-focused locations withoutappropriate authorization;
Hospitals, clinics, counseling centers, or medicalfacilities without authorization;
Places of worship in a disrespectful or disruptive manner;
Courthouses, police stations, military facilities,government-restricted areas, or emergency-response facilities;
Cemeteries, memorials, or sites of tragedy in adisrespectful manner;
Dangerous construction sites, railways, highways, industrialsites, waterways, rooftops, abandoned buildings, or restricted areas.
11.5 Creator Responsibility for Location Claims
The Hunt is not responsible for verifying the safety,legality, authorization, accessibility, business hours, conditions, orsuitability of locations selected by creators.
Creators are solely responsible for claims, complaints,demands, fines, losses, injuries, or disputes arising from locations, routes,venue references, QR placement, property use, or user activity associated withtheir Creator Hunts.
12. User Content and Creator Content
12.1 Definition
“User Content” means any content, information, material,data, text, image, audio, video, location, route, clue, puzzle, answer, hint,profile information, comment, message, QR-related content, Creator Hunt, reviewsubmission, report, feedback, sponsor content, discovery page, offer, businessprofile information, or other material that you upload, create, submit, edit,publish, share, transmit, or make available through the Services.
“Creator Content” is User Content created or submittedthrough the creator tools or used in a Creator Hunt.
12.2 You Keep Ownership of Your Content
As between you and The Hunt, you retain ownership of UserContent that you own. These Terms do not transfer ownership of your originalUser Content to The Hunt.
However, you grant The Hunt the rights described below sothat we can operate, host, display, review, moderate, improve, promote,advertise, market, publicize, enforce, protect, and provide the Services.
12.3 License to The Hunt
By creating, uploading, submitting, saving, editing,sharing, publishing, inviting users to, launching, displaying, linking,associating with a QR code, associating with a location, associating with asponsor record, or otherwise making User Content available through theServices, you grant The Hunt a worldwide, non-exclusive, royalty-free, fullypaid, transferable, sublicensable license to host, store, reproduce, copy,process, analyze, scan, review, moderate, modify, adapt, edit, excerpt,summarize, format, reformat, translate, transcode, display, perform,distribute, transmit, publish, make available, promote, advertise, market,publicize, remove, disable, archive, and otherwise use your User Content inconnection with the Services and The Hunt’s business.
This license includes the right to use User Content to:
Provide, operate, maintain, secure, support, and improve theServices;
Enable users to access and participate in Hunts you create,share, sponsor, customize, or submit;
Display your content to invited users, team members,players, reviewers, moderators, support personnel, administrators, sponsors,territory managers, and other intended or operational audiences;
Review, test, approve, reject, edit, adapt, curate, publish,or remove submitted Hunts;
Format content for different devices, screens, app versions,accessibility requirements, and promotional materials;
Detect and prevent fraud, abuse, safety issues, policyviolations, infringement, unlawful conduct, payment misuse, app-storecompliance issues, or technical issues;
Enforce these Terms and any applicable guidelines;
Provide support, debugging, quality control, moderation, andadministrative review;
Create aggregated, anonymized, de-identified, or derivedanalytics;
Create screenshots, previews, demos, examples, app-storematerials, website content, social-media content, email content,advertisements, pitch materials, sponsor materials, investor materials,territory-manager materials, press materials, and other marketing or publicitymaterials;
Publicize that a Hunt, creator, sponsor, location, type ofcreator experience, or category of content exists on or through The Hunt;
Promote Creator Access, public Hunts, private Hunts, sponsorparticipation, QR-code features, custom Hunts, territory launches, and The Huntgenerally;
Comply with legal, regulatory, app-store, operational,accounting, tax, archival, safety, or dispute-resolution obligations.
This license does not transfer ownership of your originalUser Content to The Hunt. As between you and The Hunt, you retain whateverownership rights you already have in your original User Content. However, youmay not revoke the rights The Hunt needs to operate, support, enforce, defend,archive, analyze, promote, advertise, market, publicize, or preserve theServices as described in these Terms.
Unless a separate written agreement signed by The Hunt saysotherwise, The Hunt is not required to compensate you for using User Contentunder this license.
12.4 Public or Approved Creator Hunts
If you submit a Creator Hunt for public review, publication,promotion, marketplace discovery, sponsorship, official use, territory launch,or other public-facing use, you grant The Hunt permission to review, edit,adapt, curate, approve, reject, publish, unpublish, remove, promote, display,market, distribute, feature, and otherwise use that Creator Hunt in connectionwith the Services and The Hunt’s business, subject to any separate writtenagreement between you and The Hunt.
Unless otherwise agreed in writing, submission, review,approval, or publication of a Creator Hunt does not entitle you tocompensation, revenue share, ownership in The Hunt, sponsorship rights,analytics access, promotion, or continued availability.
Unless otherwise agreed in writing, if a Creator Hunt isapproved for public publication, you authorize The Hunt to make the CreatorHunt publicly available and promote it for an initial period of up to twelvemonths after publication. After that initial period, you may request removal bygiving The Hunt at least thirty days’ written notice.
The Hunt may remove, restrict, unpublish, disable, edit, orstop promoting any public or approved Creator Hunt at any time, with or withoutnotice, for legal, safety, content, quality, app-store, sponsor, location,business, operational, intellectual-property, brand, user-experience, or otherreasons.
Removal from public availability does not eliminate TheHunt’s archival, legal, moderation, analytics, backup, prior promotional,dispute-resolution, enforcement, or surviving license rights.
12.5 Feedback
If you provide suggestions, ideas, improvements, bugreports, feature requests, business concepts, Hunt concepts, puzzle formats,story structures, gameplay mechanics, or other feedback, you grant The Hunt theright to use that feedback without restriction or compensation. Feedback is notconfidential unless we have entered into a separate written agreement signed byThe Hunt.
12.6 Private Content Is Not Confidential From The Hunt
Private Creator Hunts are private from the general publicunless shared, submitted, approved, or published as described in the Services.Private status does not mean that the content is confidential from The Hunt.
The Hunt, its administrators, contractors, serviceproviders, moderation tools, support personnel, technical systems, legalrepresentatives, and operational partners may access, store, review, process,test, display, preserve, and use private Creator Hunts and other User Contentas needed to operate, support, moderate, enforce, protect, analyze, market,promote, advertise, or improve the Services.
Do not upload content to the Services that you are notcomfortable being accessed by The Hunt for those purposes.
12.7 Deletion, Unpublishing, and Archived Content
You may delete, unpublish, disable, or stop sharing certainUser Content or Creator Hunts using the tools made available in the Services,subject to technical, operational, legal, payment, app-store, archival, backup,and dispute-resolution limitations.
Deleting, unpublishing, disabling, or removing User Contentdoes not automatically:
Cancel past purchases, subscriptions, activations, playeraccess, or transactions;
Create a refund obligation;
Remove content from backups, logs, moderation records,support records, analytics, screenshots, reports, legal files, app-storerecords, accounting records, tax records, dispute records, security records, orarchived systems;
Remove content from devices, screenshots, recordings,communications, or records of users who already accessed it;
Require The Hunt to withdraw prior promotional, marketing,app-store, investor, sponsor, territory-manager, press, or business materialsalready created, published, distributed, or used;
Terminate The Hunt’s rights needed for operation,enforcement, legal compliance, archival, moderation, safety, analytics,accounting, dispute resolution, prior promotional use, or protection of TheHunt.
The Hunt may preserve removed, disabled, unpublished, ordeleted content as needed for legal, operational, moderation,dispute-resolution, safety, app-store, business, accounting, backup, orcompliance purposes.
12.8 Platform Data and Analytics
The Hunt owns or controls the Services, platform data,operational data, logs, analytics, reports, metadata, aggregated data,de-identified data, derived data, moderation records, QR-scan records,location-verification records, gameplay records, sponsor-visit records,activation records, and administrative records generated through or associatedwith the Services, subject to applicable law and The Hunt’s Privacy Policy.
Creators, sponsors, customizers, and users do not own playeraccounts, player personal information, app logs, analytics, QR-scan records,sponsor-visit records, location-verification data, gameplay records, orplatform-generated data.
The Hunt may provide reports, dashboards, exports,summaries, or analytics to creators, sponsors, territory managers, or partnersif and when The Hunt chooses to do so or as required by a separate writtenagreement. The Hunt is not required to provide any particular metric, report,dashboard, player list, or data export unless required by law or a separatewritten agreement.
13. The Hunt Intellectual Property
13.1 Ownership by The Hunt
The Services and all related intellectual property are ownedby The Hunt or its licensors, including:
The Hunt name, logo, branding, slogans, trade dress, visualidentity, and marketing materials;
The mobile app, website, source code, object code, software,interfaces, workflows, systems, databases, and platform architecture;
Official Hunt content, storylines, characters, puzzles,clues, hints, audio, images, graphics, animations, AR elements, videos, andrelated materials created by or for The Hunt;
Hunt templates, formats, structures, design systems,progression systems, gameplay concepts, QR-code workflows, scoring systems,achievement systems, and creator-tool frameworks;
Documentation, training materials, dashboards,administrative tools, analytics, reports, and platform tools.
Except for the limited license expressly granted to you inthese Terms, no rights are granted to you in The Hunt intellectual property.
13.2 Limited License to Use the Services
Subject to your compliance with these Terms, The Hunt grantsyou a limited, revocable, non-exclusive, non-transferable, non-sublicensablelicense to download, install, access, and use the Services for lawful personal,entertainment, educational, training, team-building, sponsor, or authorizedcreator purposes.
This license does not permit you to copy, reverse engineer,sell, sublicense, commercially exploit, scrape, clone, reskin, or createcompeting products from the Services.
13.3 Restrictions
You may not:
Copy, reproduce, distribute, sell, lease, license,sublicense, or exploit the Services;
Reverse engineer, decompile, disassemble, modify, or attemptto discover source code;
Use bots, scrapers, crawlers, automation, or data-miningtools without written permission;
Circumvent security, payment, access, moderation,age-restriction, or location-verification systems;
Remove proprietary notices;
Use The Hunt branding without permission;
Create a competing service using The Hunt’s content, design,platform structure, data, or proprietary materials;
Misrepresent your relationship with The Hunt;
Use The Hunt’s official content, characters, art, puzzles,clues, stories, or brand assets outside the Services without writtenpermission.
14. Third-Party Intellectual Property and Rights ofPublicity
14.1 No Unauthorized Third-Party Content
You may not upload, create, publish, submit, share, orinclude content that uses third-party intellectual property withoutauthorization.
This includes unauthorized use of:
Copyrighted images, illustrations, photographs, videos,songs, lyrics, sound recordings, scripts, books, articles, games, puzzles, orartwork;
Fictional characters, superheroes, cartoons, mascots, moviecharacters, television characters, video-game characters, literary characters,or franchise worlds;
Brand names, logos, slogans, product packaging, trade dress,trademarks, service marks, or company names;
Sports team names, school mascots, league marks, eventmarks, or tournament marks;
Celebrity names, images, voices, likenesses, signatures,catchphrases, or impersonations;
AI-generated content that imitates, copies, or isconfusingly similar to protected third-party content;
Content copied from the internet, social media, stock-imagesites, other apps, or other sources without a valid license.
14.2 Required Rights
You may include third-party intellectual property only ifyou own it, have a valid license, have documented permission, or have receivedprior written approval from The Hunt after providing rights documentation thatThe Hunt deems sufficient.
The Hunt is not obligated to review or approve anythird-party-rights documentation and may revoke approval if it determines thatthe use creates legal, app-store, brand, safety, business, or operational risk.
14.3 Brand and Enterprise Hunts
The Hunt may separately agree in writing to permitbusinesses, brands, schools, organizations, or other rights holders to createor sponsor Hunts using their own intellectual property.
Any such permission must be in a separate written agreementor written approval from The Hunt and does not apply to other users orunrelated content.
14.4 No Fair Use Determination by The Hunt
The Hunt does not provide legal advice and does notdetermine whether your use of third-party content qualifies as fair use,nominative use, parody, commentary, or another legal exception. You areresponsible for obtaining legal advice and ensuring that your content islawful.
15. Prohibited Content
You may not create, upload, submit, publish, share, inviteusers to, or otherwise make available any User Content or Creator Hunt that TheHunt determines, in its sole discretion, is prohibited.
Prohibited content includes content that falls into thecategories below.
15.1 Illegal, Harmful, or Unsafe Content
Prohibited content includes content that:
Violates any law, regulation, court order, or legal duty;
Encourages illegal conduct;
Promotes trespassing, vandalism, theft, fraud, evasion,hacking, or circumvention;
Encourages dangerous physical activity, reckless behavior,unsafe stunts, or harmful challenges;
Provides instructions for weapons, explosives, illegaldrugs, evasion of law enforcement, or other harmful activities;
Creates a foreseeable risk of injury, property damage,public disruption, or emergency response.
15.2 Sexual or Adult Content
Prohibited content includes content that:
Contains pornography, explicit sexual content, sexualservices, sexual solicitation, or sexually exploitative material;
Sexualizes minors or appears to involve minors in sexualcontexts;
Contains nudity or adult content that is inappropriate forThe Hunt’s audience or app-store rating;
Routes users to adult venues or sexually oriented businesseswithout proper age restrictions and prior approval.
15.3 Child Safety Violations
Prohibited content includes content that:
Exploits, endangers, sexualizes, grooms, targets, harasses,or attempts to contact minors inappropriately;
Reveals private information about minors;
Directs users to locate or approach minors, schools,playgrounds, daycares, or child-focused places in a suspicious, disruptive, orunauthorized manner;
Contains, solicits, distributes, promotes, or facilitateschild sexual abuse material or child sexual exploitation in any form.
15.4 Harassment, Bullying, Hate, or Abuse
Prohibited content includes content that:
Harasses, bullies, threatens, stalks, humiliates,intimidates, or targets any person or group;
Promotes hate, discrimination, or dehumanization based onprotected or personal characteristics;
Encourages violence, exclusion, intimidation, or abuse;
Names or identifies private individuals in a harmful,mocking, threatening, or invasive way.
15.5 Privacy and Personal Information
Prohibited content includes content that:
Reveals private, sensitive, confidential, or personallyidentifiable information without authorization;
Doxxes or attempts to identify, locate, track, shame, orexpose a person;
Uses images, names, likenesses, voices, or personal detailsof individuals without required consent;
Includes identifiable images of minors without appropriateconsent.
15.6 Intellectual Property Violations
Prohibited content includes content that:
Infringes or misappropriates copyrights, trademarks, tradesecrets, patents, publicity rights, privacy rights, or other rights;
Uses unauthorized characters, brands, logos, music, images,artwork, celebrity likenesses, fictional worlds, or protected content;
Misleads users about affiliation, sponsorship, endorsement,or authorization.
15.7 Deception, Impersonation, or Misrepresentation
Prohibited content includes content that:
Impersonates The Hunt, another user, a business, a publicofficial, a school, a brand, a celebrity, a sponsor, or any third party;
Misrepresents sponsorship, endorsement, approval, authority,or affiliation;
Creates fake offers, fake promotions, fake emergencies, fakepublic notices, or misleading instructions;
Uses QR codes or links in a deceptive, malicious, orunauthorized way.
15.8 Commercial Misuse and Spam
Prohibited content includes content that:
Contains spam, phishing, scams, malware, malicious links,unauthorized advertising, pyramid schemes, or deceptive promotions;
Uses The Hunt to collect personal information forunauthorized marketing;
Promotes unrelated products or services in a misleading,unlawful, or abusive way;
Charges users outside approved payment flows for digitalcontent or app-based functionality without The Hunt’s written permission.
15.9 Age-Restricted, Regulated, or Sensitive Products
Prohibited content includes content that:
Promotes unlawful or irresponsible use of alcohol, tobacco,nicotine, cannabis, controlled substances, firearms, weapons, gambling,financial products, medical products, health treatments, adult services, orother regulated goods or services;
Targets minors with age-restricted products or venues;
Fails to apply proper age restrictions where required;
Violates app-store rules or applicable law regardingregulated products or services.
15.10 Inappropriate or Low-Quality Platform Use
Prohibited content includes content that:
Is grossly offensive, obscene, shocking, inflammatory, orinconsistent with the intended purpose of The Hunt;
Creates a poor, broken, unsafe, misleading, or abusive userexperience;
Attempts to manipulate ratings, leaderboards, scoring,payments, subscriptions, or analytics;
Overloads, damages, disrupts, or interferes with theServices;
Harms The Hunt’s reputation, users, partners, app-storestanding, legal compliance, or business relationships.
16. Content Review, Scanning, Moderation, and TakedownRights
16.1 Right to Review and Scan
The Hunt may review, scan, analyze, moderate, monitor, orevaluate User Content, Creator Hunts, sponsor content, QR codes, locations,metadata, prompts, AI-generated content, images, text, audio, links, reports,and user activity.
Review may be automated, manual, AI-assisted, keyword-based,image-based, metadata-based, complaint-based, sample-based, risk-based, orotherwise conducted as The Hunt determines appropriate.
16.2 No Obligation to Pre-Screen
The Hunt may review content, but is not obligated topre-screen every Creator Hunt, private Hunt, invited Hunt, QR code, uploadedfile, image, clue, location, answer, sponsor offer, discovery page, or usersubmission before it becomes accessible to invited users or other intendedaudiences.
You remain responsible for your content whether or not TheHunt reviews it.
16.3 Enforcement Rights
If The Hunt determines, suspects, or receives a complaintthat User Content, a Creator Hunt, a location, a QR code, a sponsor record, adiscovery page, an offer, an account, or activity may violate these Terms,applicable law, app-store rules, third-party rights, safety standards, or TheHunt’s business interests, The Hunt may take any action it deems appropriate,with or without notice, including:
Remove, hide, edit, label, restrict, disable, or unpublishcontent;
Change a Hunt from General to Mature;
Add, change, or enforce an age restriction;
Disable QR codes, links, invites, teams, or access to aHunt;
Reject a Hunt submitted for public review;
Remove a Hunt from public discovery or promotion;
Restrict or suspend creator tools;
Restrict, suspend, or terminate an account;
Revoke premium access or creator access;
Prevent future account creation;
Preserve records for investigation;
Notify affected users, partners, app stores, rights holders,property owners, sponsors, or authorities;
Report suspected unlawful conduct;
Cooperate with law enforcement, regulators, app stores,rights holders, property owners, or sponsors;
Seek reimbursement, indemnity, damages, or other legalremedies.
The Hunt is not required to provide warnings, appeals,refunds, reinstatement, or an opportunity to cure before taking action.
16.4 No Refunds for Violations
Except where required by law or app-store policy, The Huntis not obligated to provide refunds, credits, extensions, replacement access,or compensation if your access, subscription, Creator Hunt, content, QR code,public submission, sponsor record, discovery page, offer, account, or featureis removed, restricted, suspended, or terminated because of actual or suspectedviolation of these Terms.
16.5 App-Store Compliance
The Hunt may remove, restrict, or modify content or featuresto comply with Apple App Store, Google Play, payment-platform, legal,regulatory, or safety requirements, even if the content or feature does nototherwise violate these Terms.
16.6 Appeals and Review Requests
If The Hunt removes, disables, restricts, relabels, or takesother action against User Content, a Creator Hunt, sponsor content, a QR-coderecord, a location, an offer, a public submission, or an account, the affecteduser may request review by contacting The Hunt at:

or any dedicated reporting or appeals email The Hunt makesavailable.
A review request should include the user’s name, accountemail, Hunt name, content type, explanation of the issue, and the reason theuser believes the action should be reversed or modified.
The Hunt may, but is not required to, reinstate content,revise a decision, provide a detailed explanation, continue correspondence, oroffer any particular remedy. The Hunt’s decision after review is final unlessThe Hunt chooses to reopen the matter.
17. Reporting Content, Users, or Safety Issues
The Hunt provides or may provide tools for users to reportinappropriate content, unsafe Hunts, incorrect age ratings,intellectual-property concerns, abusive users, suspected child-safety issues,unauthorized use of a location, unsafe AR or location anchoring, sponsorissues, QR-code issues, or other concerns.
For versions of the Services that include user-generatedcontent, creator content, public creator content, private Creator Hunts,sponsor content, QR-code content, or AR/location-based user content, The Huntmay require in-app reporting tools and related moderation workflows.
Reports may be submitted through the reporting toolsavailable in the app and may also be submitted by contacting:

Reports should include enough information for The Hunt toinvestigate, such as the Hunt name, creator name, user name, location,screenshot, QR code, content type, report reason, description of the issue,date and time, and any relevant rights documentation.
The Hunt may investigate reports and take action in its solediscretion. We do not guarantee any particular outcome, timing, response,explanation, reinstatement, or remedy.
The Hunt may preserve copies of reported content, relatedrecords, account information, user activity, QR-code records, location records,sponsor records, and moderation history for legal, safety, support, archival,enforcement, app-store, business, or dispute-resolution purposes.
If you believe there is an emergency or immediate threat tosafety, contact local emergency services. The Hunt is not an emergencyreporting service.
18. Blocking, Invites, and User Controls
The Services may allow users to block other users, blockcreators, leave teams, decline invitations, revoke invitations, removeparticipants from a Creator Hunt, restrict access to a Creator Hunt, reportabusive users, report content, or use other safety and control tools.
For versions of the Services that include user-generatedcontent, creator content, public creator content, private Creator Hunts,sharing, invites, teams, user interaction, or other user-to-user exposure, TheHunt may provide in-app reporting, blocking, or user-control tools as requiredby applicable app-store policies and as appropriate for the functionality ofthe Services.
Blocking or reporting a user may not remove all priorcontent, reverse past gameplay, cancel transactions, prevent all indirectexposure, or remove content from all records, backups, screenshots, devices, orarchives.
You agree not to use invitations, team features, QR codes,shared links, usernames, gameplay features, creator tools, sponsor tools, orcommunication features to harass, stalk, threaten, spam, impersonate, deceive,exploit, or abuse another person.
The Hunt may restrict, remove, or disable invite, sharing,team, messaging, creator, sponsor, QR-code, or communication features if webelieve they are being misused.
19. Copyright Complaints and DMCA Policy
19.1 Reporting Copyright Infringement
If you believe that content available through the Servicesinfringes your copyright, you may submit a written notice to The Hunt’sdesignated copyright contact.
Until The Hunt designates a separate copyright agent,copyright notices may be sent to:

A copyright notice should include:
A physical or electronic signature of the copyright owner ora person authorized to act on behalf of the copyright owner;
Identification of the copyrighted work claimed to have beeninfringed, or, if multiple copyrighted works are covered by a single notice, arepresentative list of those works;
Identification of the material claimed to be infringing andinformation reasonably sufficient to permit The Hunt to locate the material;
Information reasonably sufficient to permit The Hunt tocontact you, such as your name, address, telephone number, and email address;
A statement that you have a good-faith belief that use ofthe material in the manner complained of is not authorized by the copyrightowner, its agent, or law;
A statement that the information in the notice is accurateand, under penalty of perjury, that you are the copyright owner or authorizedto act on behalf of the copyright owner.
The Hunt may remove or disable access to allegedlyinfringing content and may notify the user who submitted the content.
19.2 Counter-Notification
If you believe your content was removed or disabled bymistake or misidentification, you may submit a written counter-notification toThe Hunt.
A counter-notification should include:
Your physical or electronic signature;
Identification of the material that was removed or disabledand the location where the material appeared before it was removed or disabled;
A statement under penalty of perjury that you have agood-faith belief that the material was removed or disabled as a result ofmistake or misidentification;
Your name, address, telephone number, and email address;
A statement that you consent to the jurisdiction of thefederal district court for the judicial district in which your address islocated, or if your address is outside the United States, the federal districtcourt for the Western District of Michigan, and that you will accept service ofprocess from the person who provided the original copyright complaint or thatperson’s agent.
The Hunt may forward a counter-notification to the party whosubmitted the original copyright complaint. The Hunt may restore removedcontent in accordance with applicable law unless the copyright claimantnotifies The Hunt that it has filed an action seeking a court order to restrainthe user from engaging in infringing activity.
19.3 Repeat Infringers
The Hunt may terminate or restrict accounts of users whorepeatedly infringe copyrights or other intellectual-property rights. The Huntmay determine, in its sole discretion, what constitutes repeat infringement orappropriate circumstances for termination.
19.4 Misrepresentations
Submitting false, misleading, or bad-faith copyrightcomplaints or counter-notifications may result in legal liability. The Hunt mayreject incomplete notices and may request additional information before takingaction.
19.5 DMCA Agent Registration
The Hunt may register a designated DMCA agent with the U.S.Copyright Office and may update these Terms or its website to identify thedesignated agent.
20. Teams, Gameplay, Scores, Achievements, and Leaderboards
20.1 Teams and Roles
The Services may allow users to participate in Huntsindividually or as part of a team. Team functionality may include roles such ashost, creator, participant, captain, navigator, or other gameplay roles.
If one person acts on behalf of a team, such as by scanninga QR code, entering an answer, accepting a clue, redeeming an offer, advancingto the next step, or completing a Hunt, that action may affect the entire team.
You are responsible for coordinating with your team. TheHunt is not responsible for missed clues, missed redemptions, incompleteparticipation, team disagreements, player confusion, or actions taken by oneteam member that affect other team members.
20.2 Gameplay Data
The Services may record gameplay data, including check-ins,QR scans, answers, time stamps, locations, progress, hints used, achievements,completion status, and other gameplay activity.
Gameplay data may be used to operate the Services, calculateprogress, support teams, validate offers, maintain fairness, troubleshooterrors, provide analytics, detect misuse, and improve the Services.
20.3 Scores, Achievements, Badges, and Rankings
The Services may include scores, achievements, badges,progress indicators, rankings, and leaderboards. These features are providedfor entertainment and engagement purposes only.
Scores, rankings, achievements, and similar features may beapproximate, delayed, incomplete, changed, corrected, removed, or reset at anytime. The Hunt may adjust or remove scores, achievements, rankings, or rewardsif we believe there has been an error, technical issue, cheating, misuse,fraud, policy violation, or other problem.
20.4 No Monetary Value
Unless expressly stated otherwise in writing by The Hunt,points, scores, achievements, badges, digital rewards, ranks, and similarin-app features have no cash value, are not property, are not redeemable formoney, and may not be transferred, sold, traded, or exchanged.
21. Retailers, Sponsors, Venues, Offers, and Third-PartyBusinesses
21.1 Independent Third Parties
The Services may involve participating retailers, sponsors,restaurants, bars, venues, municipalities, schools, organizations, propertyowners, event operators, or other third parties.
These third parties are independent from The Hunt unless weexpressly state otherwise in writing. They are not employees, agents, partners,joint venturers, or legal representatives of The Hunt.
21.2 No Control Over Third Parties
The Hunt does not control and is not responsible for:
Business operations;
Staff conduct;
Venue conditions;
Hours of operation;
Admission or age-verification policies;
Denial of entry or refusal of service;
Product or service quality;
Food or beverage preparation;
Allergens or ingredients;
Alcohol service;
Prices, menus, inventory, or availability;
Cleanliness, safety, or security;
Accessibility;
Parking;
Crowd conditions;
Third-party promotions;
Third-party websites, apps, or payment systems.
You interact with third-party businesses, venues, sponsors,retailers, and locations at your own risk.
21.3 Offers and Promotions
The Services may display offers, discounts, coupons,promotions, rewards, or other benefits provided by third-party businesses.
Offers may be subject to additional terms, restrictions,expiration dates, age requirements, purchase requirements, availability limits,blackout dates, or conditions imposed by the applicable third party.
The Hunt does not guarantee that any offer will beavailable, honored, redeemable, accurate, suitable, or unchanged. A third partymay modify, refuse, suspend, or discontinue an offer at any time.
21.4 Age-Restricted Products and Services
If a third party offers alcohol, cannabis, tobacco,nicotine, gambling, age-restricted entertainment, or other regulated productsor services, the third party is solely responsible for compliance withapplicable laws, including age verification, identification checks, licensing,advertising, and service decisions.
The Hunt does not sell, furnish, serve, deliver, or providealcohol, cannabis, tobacco, nicotine, gambling products, firearms, or otherage-restricted products.
21.5 No Sponsorship Unless Stated
A location’s appearance in a Hunt does not necessarily meanthat the location sponsors, endorses, approves, participates in, or isaffiliated with The Hunt or the applicable Hunt.
This is especially important for Creator Hunts. Creatorsmust not imply sponsorship, endorsement, approval, or participation by anythird party unless they have proper written authorization.
21.6 Sponsor Content, QR Records, and Discovery Pages
Sponsors, retailers, venues, territory managers, andauthorized business representatives may be allowed to create, edit, submit, orpublish business profiles, location records, QR-code records, sponsor discoverypages, offers, redemption instructions, images, logos, descriptions, hours, agerestrictions, links, staff instructions, promotional copy, and othersponsor-related content.
All sponsor-submitted content is User Content under theseTerms.
Sponsors are responsible for ensuring that their content isaccurate, lawful, current, non-infringing, properly authorized, not misleading,and appropriate for the Services.
21.7 Sponsor Ownership and License
As between the sponsor and The Hunt, the sponsor retainswhatever ownership rights it has in its own original sponsor-submitted content,trademarks, logos, business names, product names, images, and offer copy.
By submitting sponsor content, the sponsor grants The Huntthe license described in Section 12, including the right to host, display,edit, format, promote, advertise, market, publicize, distribute, review,moderate, remove, disable, archive, and otherwise use the sponsor content inconnection with the Services and The Hunt’s business.
This includes the right to use sponsor names, logos, offers,location information, discovery pages, QR-code records, screenshots, andrelated materials to promote The Hunt, sponsor participation, Hunts, territorylaunches, and related services.
21.8 Sponsor Offers and Instant Updates
Sponsor content, offers, QR-code records, discovery pages,and related updates may be displayed shortly after submission or update. TheHunt is not required to pre-review every sponsor update before it becomesvisible.
The Hunt may review sponsor content before or afterpublication and may edit, reject, remove, disable, restrict, or require changesto any sponsor content at any time.
The Hunt may notify an administrator when sponsor content oroffer content is created or changed, but The Hunt does not guarantee that everyissue will be identified before users see the content.
21.9 Sponsor Content Standards
Sponsor content may not be illegal, misleading, deceptive,infringing, unsafe, hateful, harassing, explicit, pornographic, defamatory,fraudulent, malicious, or otherwise prohibited under these Terms.
Sponsors may not submit false offers, expired offers,bait-and-switch promotions, misleading discounts, unauthorized third-partypromotions, unlawful medical or health claims, unlawful financial claims, orcontent that violates app-store rules, advertising laws, consumer-protectionlaws, alcohol laws, cannabis laws, gambling laws, tobacco laws, or otherregulated-product laws.
Age-restricted offers, venues, products, or services must beaccurately labeled and must comply with applicable law. The Hunt may require18+ or 21+ restrictions for certain sponsor content.
21.10 Sponsor Responsibility
Sponsors are solely responsible for their businessoperations, staff training, offer terms, redemption decisions, compliance withlaw, age verification, product availability, customer service, and userinteractions at their locations.
The Hunt may encourage sponsors to communicate offer detailsto staff, but The Hunt is not responsible for whether sponsor staff understand,honor, explain, or administer an offer.
22. Purchases, Subscriptions, Premium Access, Player Packs,Billing, and Refunds
22.1 Paid Features
The Services may include paid features, includingsubscriptions, creator access, premium features, player packs, expanded teamcapacity, additional Hunt activations, paid content, or other digital products.
Available features, pricing, limits, and benefits may varyby platform, territory, account type, promotion, app version, or time.
22.2 App Store and Google Play Billing
Purchases made through the Apple App Store or Google Playare processed by Apple or Google, not directly by The Hunt. Your purchase issubject to the applicable app store’s payment terms, subscription rules, refundpolicies, and account settings.
The Hunt does not receive or store your full payment-cardinformation for purchases processed through Apple or Google.
22.3 Subscriptions
Subscriptions may automatically renew unless canceled beforethe renewal date in accordance with the applicable app store’s rules.
You are responsible for managing and canceling subscriptionsthrough your Apple App Store, Google Play, or other applicable accountsettings. Deleting the app or deleting your The Hunt account may notautomatically cancel your app-store subscription.
22.4 Player Packs and One-Time Purchases
Player packs, additional activations, or other one-timedigital purchases may be subject to usage limits, expiration rules, accountrestrictions, or feature-specific terms displayed at the time of purchase.
Unless required by law or applicable app-store policy,unused or partially used player packs, activations, creator features, ordigital purchases are not refundable.
22.5 Changes to Paid Features
The Hunt may add, remove, modify, limit, suspend, ordiscontinue paid features, pricing, packages, entitlements, or benefits at anytime, subject to applicable law and app-store requirements.
If a paid feature is modified, suspended, or discontinued,your remedies, if any, are limited to those required by applicable law or theapplicable app-store policy.
22.6 Refunds
Refund requests for purchases made through Apple or Googlemust generally be submitted to Apple or Google.
Except where required by law or applicable app-store policy,The Hunt is not obligated to provide refunds, credits, extensions, orcompensation for:
User dissatisfaction;
Incomplete Hunts;
Unused subscriptions;
Unused player packs;
Unused creator access;
Deleted or unpublished Creator Hunts;
Missed offers;
Technical interruptions;
Account suspension or termination for violation of theseTerms;
Content removed for legal, safety, app-store,intellectual-property, or policy reasons.
23. Acceptable Use and User Conduct
You agree that you will not:
Use the Services for any unlawful, harmful, fraudulent,abusive, deceptive, or unauthorized purpose;
Violate any applicable law, regulation, ordinance, venuerule, property rule, or third-party right;
Trespass, enter restricted areas, damage property,vandalize, litter, or interfere with public or private property;
Harass, threaten, intimidate, stalk, abuse, bully, defame,or harm others;
Interfere with businesses, employees, customers, residents,schools, public spaces, or other users;
Use the app while driving or operating a vehicle;
Engage in reckless, unsafe, disruptive, or dangerousconduct;
Cheat, spoof GPS, manipulate location, falsify check-ins,misuse QR codes, or manipulate scores;
Scan QR codes on behalf of unauthorized users or teams;
Sell, trade, share, or misuse offers, rewards, invitations,links, or QR codes;
Upload, create, submit, or share prohibited content;
Violate intellectual-property, privacy, publicity, orproperty rights;
Attempt to bypass payment, subscription, entitlement,moderation, age-restriction, location-verification, or access controls;
Reverse engineer, decompile, disassemble, scrape, crawl,copy, or clone the Services;
Use bots, scripts, automation, or data-mining tools withoutwritten permission;
Introduce malware, spyware, harmful code, phishing links, ormalicious QR codes;
Overload, disrupt, damage, or interfere with the Services orrelated systems;
Impersonate The Hunt, another user, a business, a sponsor, apublic official, or any third party;
Misrepresent affiliation, sponsorship, approval, orauthority;
Use the Services to collect personal information from userswithout authorization;
Use the Services for unauthorized commercial purposes.
The Hunt may investigate suspected violations and take anyaction we deem appropriate.
24. AI-Assisted Features
24.1 AI Features
The Services may include AI-assisted tools that help create,edit, summarize, narrate, translate, review, moderate, or improve Hunt content,clues, stories, puzzles, descriptions, images, audio, or other materials.
AI-assisted features are tools only. You remain responsiblefor all content you create, submit, publish, or share, including contentgenerated or suggested by AI.
24.2 No Guarantee of Accuracy or Originality
AI-generated or AI-assisted content may be inaccurate,incomplete, inappropriate, infringing, repetitive, misleading, or unsuitable.You are responsible for reviewing and editing AI-assisted output before usingit.
The Hunt does not guarantee that AI-assisted content isoriginal, non-infringing, safe, accurate, appropriate, or legally compliant.
24.3 No Sensitive Inputs
You should not submit confidential information, sensitivepersonal information, private information about others, trade secrets,protected health information, financial information, or information aboutminors into AI-assisted features unless you have the right to do so and intendfor that information to be processed.
24.4 AI Content Moderation and Reporting
The Hunt may review, scan, restrict, remove, or disableAI-generated or AI-assisted content that violates these Terms, app-store rules,applicable law, third-party rights, safety standards, or our platform policies.
Users may report offensive, unsafe, infringing, orinappropriate AI-generated content through available reporting tools or bycontacting hq@jointhehunt.io.
24.5 AI-Generated Content Responsibility
If you use AI-assisted tools to create or modify UserContent, you remain responsible for the resulting content.
You may not use AI-assisted tools to create, upload, orshare content that infringes rights, impersonates real people withoutauthorization, creates non-consensual sexual material, exploits or endangersminors, facilitates scams, creates fake official documents, generates maliciouscode, encourages harmful behavior, enables harassment, or violates these Terms.
25. Communications and Notifications
25.1 Service Communications
By using the Services, you may receive transactional,account-related, safety-related, gameplay-related, subscription-related,support-related, sponsor-related, creator-related, moderation-related, or legalcommunications from The Hunt. These communications may be sent by email, pushnotification, in-app message, SMS if enabled, or other available methods.
25.2 Push Notifications
If you enable push notifications, we may send notificationsrelated to Hunts, reminders, team activity, creator activity, account status,offers, updates, safety notices, sponsor activity, moderation, or otherapp-related messages.
You may disable push notifications through your devicesettings.
25.3 Promotional Communications
We may send promotional communications where permitted bylaw. You may opt out of promotional emails by using the unsubscribe mechanismprovided or by contacting us.
Opting out of promotional communications does not prevent usfrom sending non-promotional service, account, legal, safety, or transactionalmessages.
26. Technical Limitations and Service Availability
26.1 No Guarantee of Availability
The Services may be unavailable, interrupted, delayed,inaccurate, or error-prone. The Hunt does not guarantee that the Services,Hunts, creator tools, QR codes, subscriptions, offers, maps, AR features,sponsor features, reporting tools, blocking tools, or any other feature will beavailable at all times, in all locations, or on all devices.
26.2 Causes of Interruption
Service issues may result from:
Maintenance;
Software bugs;
Device limitations;
Operating system updates;
Network failures;
GPS or location-service errors;
Third-party service provider issues;
App-store issues;
Mapping-service issues;
Cloud-hosting issues;
Cyberattacks or security events;
Force majeure events;
Business or operational decisions.
26.3 No Liability for Technical Issues
To the fullest extent permitted by law, The Hunt is notliable for technical issues, including:
Inability to access or complete a Hunt;
Inability to scan a QR code;
Inability to verify a location;
Loss of progress, scores, or achievements;
Lost or corrupted content;
Device incompatibility;
App crashes;
Delayed or missed notifications;
Failed uploads or downloads;
Unavailable creator tools;
Unavailable paid features;
Missed offers or redemptions;
Reporting, blocking, moderation, or review delays.
27. Third-Party Services, Links, Maps, and Tools
The Services may integrate with or link to third-partyservices, including app stores, payment processors, authentication providers,mapping providers, analytics providers, cloud providers, AI providers,moderation providers, social media platforms, websites, retailers, sponsors,venues, and other third-party tools.
The Hunt does not control and is not responsible forthird-party services, content, policies, availability, accuracy, security,privacy practices, or terms.
Your use of third-party services is subject to theapplicable third party’s terms and privacy policies.
28. Platform-Specific Terms
28.1 Apple App Store
If you downloaded or accessed the app through the Apple AppStore, the following applies:
These Terms are between you and The Hunt, not Apple.
Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or supportfor the app.
To the maximum extent permitted by law, Apple has nowarranty obligation with respect to the app.
Apple is not responsible for claims relating to the app,your use of the app, product liability, legal compliance, consumer protection,or intellectual-property claims.
Apple and its subsidiaries are third-party beneficiaries ofthese Terms and may enforce these Terms against you as a third-partybeneficiary.
You must comply with applicable third-party terms when usingthe app.
28.2 Google Play
If you downloaded or accessed the app through Google Play,your use of the app may also be subject to Google Play’s applicable terms,policies, billing rules, refund rules, and account settings.
Google is not responsible for providing support,maintenance, warranties, or remedies relating to the Services except asrequired by applicable Google Play policies or law.
28.3 Device and Carrier Requirements
You are responsible for obtaining and maintaining acompatible device, operating system, internet connection, data plan, locationservices, and any other hardware or services needed to use the Services.
Your carrier or service provider may charge data, messaging,roaming, or other fees. You are responsible for those charges.
29. Disclaimers
29.1 Services Provided “As Is”
To the fullest extent permitted by law, the Services areprovided on an “AS IS” and “AS AVAILABLE” basis, without warranties of anykind, whether express, implied, statutory, or otherwise.
29.2 No Implied Warranties
The Hunt disclaims all warranties, including warranties ofmerchantability, fitness for a particular purpose, title, non-infringement,accuracy, availability, reliability, safety, security, and uninterruptedoperation.
29.3 No Guarantee of Experience
The Hunt does not warrant that:
Any Hunt will be enjoyable, safe, available, accurate,complete, or error-free;
Any location will be open, accessible, lawful, safe,suitable, or properly described;
Any offer will be honored, available, or redeemable;
Any Creator Hunt will be appropriate, authorized, safe,lawful, or non-infringing;
Any sponsor content will be accurate, lawful, current,appropriate, or honored;
Any user, creator, retailer, venue, sponsor, or third partywill act appropriately or lawfully;
The Services will be uninterrupted, secure, virus-free, orfree of harmful components;
Errors or defects will be corrected.
29.4 No Professional Advice
The Services do not provide legal, safety, emergency,medical, transportation, event-management, child-supervision, security, orprofessional advice. You are responsible for obtaining any professional adviceor permissions needed for your activities.
30. Limitation of Liability
30.1 Exclusion of Damages
To the fullest extent permitted by law, The Hunt Partiesshall not be liable for any indirect, incidental, special, consequential,exemplary, punitive, or enhanced damages, including loss of profits, loss ofrevenue, loss of data, loss of goodwill, loss of content, businessinterruption, personal injury, property damage, emotional distress, or otherlosses arising out of or related to the Services or these Terms.
30.2 Specific Exclusions
To the fullest extent permitted by law, The Hunt Parties arenot liable for claims arising out of or related to:
Your travel to, from, near, or between Hunt locations;
Your presence at or interaction with any location, venue,business, property, or public area;
Injuries, accidents, illness, death, or property damage;
Conditions at third-party locations;
Acts or omissions of users, creators, team members,retailers, sponsors, venues, property owners, or other third parties;
Creator Hunts or User Content;
Sponsor content, sponsor offers, discovery pages, or QR-coderecords;
Unauthorized or infringing content submitted by users;
GPS errors, mapping inaccuracies, QR-code errors, orlocation-verification failures;
Missed offers, denied entry, refused service, or unavailablevenues;
Technical failures, outages, app errors, or lost progress;
Unauthorized access to your account resulting from yourfailure to secure credentials;
Your violation of these Terms or applicable law.
30.3 Liability Cap
To the fullest extent permitted by law, The Hunt Parties’total cumulative liability for all claims arising out of or relating to theServices or these Terms shall not exceed the greater of:
The amount you paid directly to The Hunt for use of theServices in the twelve months before the event giving rise to the claim; or
Twenty-Five U.S. Dollars (US $25).
30.4 Jurisdictional Limits
Some jurisdictions do not allow certain exclusions orlimitations of liability. In those jurisdictions, liability is limited to themaximum extent permitted by law.
31. Indemnification
In addition to any other indemnification obligations inthese Terms, you agree to indemnify, defend, and hold harmless The Hunt Partiesfrom and against any and all claims, demands, actions, proceedings, damages,liabilities, losses, settlements, judgments, costs, and expenses, includingreasonable attorneys’ fees, arising out of or related to:
Your access to or use of the Services;
Your participation in any Hunt;
Your travel, conduct, or real-world activity connected tothe Services;
Your User Content or Creator Hunt;
Your sponsor content, offer, discovery page, QR-code record,business profile, or location record;
Your use of any location, venue, business, public space,private property, QR code, route, clue, or instruction;
Your violation of these Terms;
Your violation of applicable law;
Your violation or alleged violation of any third-partyright, including intellectual-property, privacy, publicity, property,contractual, consumer-protection, or advertising rights;
Your misrepresentation of sponsorship, endorsement,approval, affiliation, or authorization;
Your interaction with any user, team member, creator,business, venue, sponsor, property owner, or third party;
Any claim brought by a person you invited, supervised,organized, directed, or caused to participate in a Hunt;
Any claim by a rights holder, property owner, venue,business, school, municipality, public agency, parent, guardian, sponsor,player, invitee, customer, or other third party relating to your content,conduct, offer, location, QR code, or Hunt;
Your failure to obtain permission from a rights owner,person, parent, guardian, business, property owner, sponsor, location, or otherthird party;
Your mislabeling of content as General or Mature;
Your failure to apply appropriate 13+, 18+, or 21+restrictions;
Your use of alcohol-related, cannabis-related,adult-oriented, or otherwise age-restricted locations, offers, or content;
Any allegation that your Hunt, content, offer, QR code,route, location, instruction, or invitation caused or contributed to injury,death, property damage, trespass, harassment, business disruption, emotionaldistress, privacy invasion, reputational harm, financial harm, or other harm.
The Hunt may assume exclusive control of the defense andsettlement of any matter subject to indemnification. You agree to cooperatewith our defense of such claims. You may not settle any claim that imposesliability, obligation, admission, restriction, or expense on The Hunt withoutour prior written consent.
32. Suspension and Termination
32.1 Termination by You
You may stop using the Services at any time. You may requestaccount deletion as described in our Privacy Policy and account-deletionprocedures.
Deleting your account may not automatically cancelsubscriptions purchased through Apple, Google, or another app store. You areresponsible for managing app-store subscriptions through the applicableapp-store account settings.
32.2 Suspension or Termination by The Hunt
The Hunt may suspend, restrict, or terminate your access tothe Services, account, Creator Hunts, premium features, subscriptions, playerpacks, QR codes, links, public submissions, sponsor features, discovery pages,offers, or other features at any time, with or without notice, if we believe:
You violated these Terms;
You violated applicable law;
Your content or conduct creates legal, safety, app-store,intellectual-property, privacy, reputational, operational, or business risk;
Your account has been compromised;
You engaged in cheating, fraud, abuse, harassment, unsafeconduct, or misuse;
You used unauthorized third-party content;
You misrepresented authorization, sponsorship, oraffiliation;
Your Creator Hunt is unsafe, inappropriate, unlawful,misleading, or low quality;
Your sponsor content, discovery page, QR-code record, offer,or location record is unsafe, inappropriate, unlawful, misleading, or lowquality;
Your continued access may harm The Hunt, users, partners,app stores, third parties, or the public.
32.3 Effect of Termination
Upon suspension or termination, your right to access and usethe Services may immediately stop. We may remove, disable, or restrict accessto your content, Hunts, account, QR codes, invitations, links, scores, sponsorrecords, discovery pages, offers, or other features.
Sections that by their nature should survive terminationwill survive, including intellectual property, user-content licenses, platformdata, moderation rights, archival rights, disclaimers, limitation of liability,release, indemnification, dispute resolution, and general legal provisions.
33. Changes to the Services
The Hunt may modify, update, suspend, discontinue, replace,or remove any part of the Services at any time, including Hunts, creator tools,paid features, subscriptions, player packs, QR-code features, AR features,offers, locations, teams, scoring, leaderboards, content, sponsor features,reporting tools, blocking tools, moderation tools, or availability.
We are not liable for modifications, suspensions,discontinuations, or removals, except as required by applicable law orapp-store policy.
34. Changes to These Terms
We may update these Terms from time to time. When we do, wewill update the “Last Updated” date.
If changes are material, we may provide notice through theServices, email, website posting, in-app notice, app-store update notes, oranother appropriate method.
Your continued use of the Services after updated Termsbecome effective means you accept the updated Terms. If you do not agree toupdated Terms, you must stop using the Services.
35. Governing Law and Venue
These Terms are governed by the laws of the State ofMichigan, without regard to conflict-of-laws principles.
Except where prohibited by law, you agree that any dispute,claim, or controversy arising out of or relating to the Services or these Termsshall be brought exclusively in the state or federal courts located inKalamazoo County, Michigan, and you consent to the personal jurisdiction andvenue of those courts.
36. Class Action and Jury Trial Waiver
To the fullest extent permitted by law, you and The Huntagree that any dispute will be conducted only on an individual basis and not asa class action, collective action, consolidated action, private attorneygeneral action, or representative proceeding.
To the fullest extent permitted by law, you and The Huntwaive the right to a jury trial in any dispute arising out of or relating tothe Services or these Terms.
37. Severability
If any provision of these Terms is held to be invalid,illegal, or unenforceable, that provision will be enforced to the maximumextent permitted by law, and the remaining provisions will remain in full forceand effect.
38. Assignment
You may not assign or transfer these Terms or your rights orobligations under these Terms without The Hunt’s prior written consent.
The Hunt may assign or transfer these Terms, in whole or inpart, without restriction, including in connection with a merger, acquisition,financing, reorganization, sale of assets, change of control, or by operationof law.
39. No Waiver
The Hunt’s failure to enforce any provision of these Termsdoes not constitute a waiver of that provision or any other provision.
Any waiver must be in writing and signed by The Hunt to beeffective.
40. Entire Agreement
These Terms, together with the Privacy Policy and anyadditional terms presented for specific features, purchases, promotions,creator programs, public Hunt submissions, sponsor participation,territory-manager activity, or app-store transactions, constitute the entireagreement between you and The Hunt regarding the Services.
The Hunt’s Creator Access Guidelines, Content Guidelines,Sponsor Guidelines, Customizer Guidelines, Public Creator PublishingGuidelines, offer rules, age-rating rules, purchase terms, and feature-specificrules are incorporated into these Terms when posted, presented, linked, or madeavailable through the Services.
These Terms supersede any prior or contemporaneousagreements, communications, proposals, or understandings regarding theServices.
